How to obtain legal residency in Uruguay

Legal residency is the procedure that unlocks everything else: the identity document, formal employment, a bank account and, in time, citizenship. Here is exactly what the National Directorate of Migration requires, how to prove means of living depending on your work situation, and which requirements are absolute.

The three blocks of documentation

The file is built on identity, health and means of living. If one is missing, the application does not move forward.

1. Identity

  • Original, valid identity document. If your country requires a visa to enter Uruguay, that visa must be valid. This is an absolute requirement.
  • Criminal Record Certificate from your country of origin and from every country where you lived for six months or more during the last five years. Only for those over 18.
  • Marriage certificate or judicial recognition of a civil partnership, where a relationship must be evidenced. It cannot be more than one year old.
  • Birth certificate, where a relationship must be evidenced.
  • Passport photo, brought on the day of the hearing.

The detail that gets files rejected

The criminal record certificate must be national in scope. State, departmental or provincial certificates are not accepted. This is the most common mistake among applicants from federal countries.

All that documentation must be legalised or apostilled and translated — with one exception: Brazil does not require translation. Before anything else, sort out the apostille or legalisation and, if needed, the official translation.

If you were born in the United States there is a specific route: you can go to Interpol in Montevideo to have your fingerprints taken so that office can request the certificate from the FBI. A statement issued by your country’s consulate accredited to the Uruguayan government is also valid.

2. Health

  • Valid health card (carné de salud).
  • Vaccination certificate.

Both issued by public or private health providers authorised by the Ministry of Public Health. These are done locally — you do not need to bring them from abroad.

3. Means of living

You have to evidence a monthly nominal income sufficient for your maintenance. How you prove it depends on your situation:

  • Employee of a company: notarial income certificate including the company’s legal verification, or BPS employment history.
  • Employee of an individual (domestic service, for example): notarial certificate covering the employment relationship, the employer’s details and BPS registration number, or BPS employment history.
  • Self-employed with a sole proprietorship: notarial income certificate stating name, activity, tax address, BPS and DGI, or an accountant’s certificate of monthly income.
  • Business owner or shareholder of an SA, SRL or SAS: notarial certificate with the company’s full legal verification.
  • Employee of a foreign company: notarial certificate evidencing the relationship, the company’s details, that it has no branch in Uruguay, the amount and method of payment, and how you carry out the work from here.
  • Living on investment income, retired or pensioned abroad: notarial certificate stating the nature of the income, the monthly amount and how it is received in Uruguay.
  • Retired in Uruguay: original and copy of the latest payment receipt.

If the application is for a minor

They meet the general requirements except criminal records, and add two things:

  • Birth certificate legalised or apostilled and translated, or registered with the Uruguayan Civil Registry. This is an absolute requirement at the start of the procedure.
  • Express authorisation from both parents to settle in Uruguay. If not given in person, it goes by power of attorney valid for 180 days.

If the power of attorney is issued abroad it must be formalised by a Uruguayan notary and state expressly that it authorises residence in Uruguay. If the minor will not live with either parent, the authorisation must name the responsible adults, who also sign the application.

One practical point: the National Directorate of Civil Identification will require a birth certificate from every applicant in order to issue the identity document, so it is worth resolving the registration of foreign certificates from the outset.

What it enables and what comes next

With the residency certificate in process you can already obtain the identity card and be registered with the BPS in order to work legally. There is no need to wait for permanent residency.

Longer term, time in habitual residence is what opens the door to Uruguayan citizenship: three years with a family established here, five without. It is a separate matter from tax residency, which follows different criteria.
